2.2 All products offered are subject to availability.

2.3 You can check stock levels on each product page. Items that are out of stock will be marked as “sold out”. Occasionally this may affect availability. If an item you ordered becomes unavailable, we will contact you as soon as possible (and within the delivery timeframe below) by email or phone. We will offer you a suitable alternative or the option to cancel the order without charge. If your card has already been charged, we will issue a refund promptly.

CONSUMER PROVISIONS

HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

6.1 Our checkout process lets you review and correct any errors before submitting your order. Please check each step carefully. 6.2 The Contract is formed when you click “Confirm” or the equivalent button. Once confirmed, your order is submitted for processing and can only be changed or cancelled as set out in these Terms or as required by law. 6.3 Your confirmation of the order constitutes acceptance of these Terms and Conditions. 6.4 Our records of the transaction are conclusive evidence of the details of the Contract. In any dispute, our data will be accepted as proof of the transaction.

OUR RIGHT TO VARY THESE TERMS

7.1 We may revise these Terms when necessary because of: 7.1.1 changes in our payment methods; 7.1.2 changes in relevant laws or regulations; or 7.1.3 any other reasonable business reason. 7.2 The Terms in force at the time you place an order will apply to that Contract. 7.3 When we update these Terms we will note the new version and date at the top of the document.

YOUR RIGHT OF CANCELLATION

NOTE: This clause 8 applies only if you are a consumer resident in the UK. If you are ordering from outside the UK, please refer to clause 10. 8.1 You have a legal right to cancel the Contract within the period set out in clause 8.3 below. This means you can change your mind and receive a full refund (subject to the conditions below). 8.2 This right does not apply to made-to-order, customised, or personalised products, nor to certain items such as fragrances or candles where transportation restrictions apply. 8.3 The cancellation period begins on the date we confirm your order and lasts for 7 working days (excluding Saturdays, Sundays, and public holidays) starting the day after you receive the Products. 8.4 To cancel, please email us at hello@cosmacure.com. We recommend you keep a copy of the cancellation notice. Cancellation takes effect on the date you send the email. 8.5 We recommend you return the Products in their original, unused condition with all original packaging, using a secure and trackable shipping method. Returns should be sent to: Cosmacure c/o [insert return address]. You are responsible for the cost and risk of return shipping unless otherwise stated. 8.6 Provided the Products are returned in accordance with these conditions, we will refund the full value of the Products (minus original shipping costs) within 30 days of receiving your cancellation notice. 8.7 This cancellation right must be exercised by formal written notice within the 7-working-day period described above.

RETURNS

NOTE: If you are ordering from outside the UK, the cancellation right in clause 8 does not apply. Your return rights are limited to the provisions in this clause 9. 9.1 You must inspect the Products immediately upon receipt. If they are damaged, defective, or incorrectly supplied, you must notify us by email at hello@cosmacure.com as soon as possible, and in any event within a reasonable time, providing details of the issue. 9.2 We may, at our discretion, allow exchanges for non-faulty items once, subject to the conditions below. 9.3 All returns must be made in one shipment and within 30 days of delivery. Fragmented returns may incur extra costs. 9.4 You are responsible for all import duties and taxes on international orders. We cannot refund these charges. 9.5 We recommend you retain proof of postage. 9.6 Refunds will be issued to the original payment card and may be subject to deduction for any damage or deterioration to returned goods. 9.7 Card refunds can take up to 10 business days to appear on your statement, depending on your card issuer. 9.8 This returns policy does not affect your statutory legal rights.

PRICE OF PRODUCTS AND DELIVERY CHARGES

10.1 We make every effort to ensure prices are correct. If we discover an error in the price of Products you have ordered, we will contact you and give you the option to proceed at the correct price or cancel the order. If we cannot contact you, we will treat the order as cancelled and notify you in writing. If the pricing error is obvious and unmistakable, we are not obliged to supply the Products at the incorrect lower price. 10.2 UK VAT is included in the price for orders delivered within the UK. 10.3 International orders are handled under clause 11.

INTERNATIONAL SALES AND DELIVERY

11.1 We ship on a DDU (Delivered Duty Unpaid) basis to selected destinations outside the UK. Prices shown on the website include UK VAT; this will be removed at checkout for international orders. You are responsible for all import duties, taxes, and customs charges, which must be paid at checkout where applicable. 11.2 You must comply with all laws and regulations of the destination country. We accept no liability if you breach any such laws. 11.3 Certain products (including those containing CITES-restricted materials) cannot be shipped outside the UK. We will indicate this on the product page where possible. You may need to remove such items from your cart or change your delivery country to proceed.

SHIPPING INFORMATION

12.1 Orders are normally processed and shipped within one working day of receipt. Orders placed before 14:00 London time on a working day will usually be dispatched the same day, unless prevented by circumstances beyond our control. 12.2 Delivery is completed when the Products reach the address you provided. 12.3 Once an order is placed, the delivery address cannot be changed. 12.4 We may need to verify your payment details with your card issuer before dispatching. 12.5 We insure goods while in transit until delivery. A signature is usually required, at which point responsibility passes to you. If you nominate another recipient, their signature (or evidence of delivery at the given address) will be accepted as proof of delivery. 12.6 Some carriers offer signature-free options. If you select this and the parcel is left in a safe place or with a neighbour, you accept full responsibility for any loss or damage after delivery.

HOW TO PAY

13.1 We accept payment by the following cards: Visa, Visa Debit, Mastercard, Maestro, and American Express. 13.2 Payment must be made in full at the time of ordering.

OUR LIABILITY IF YOU ARE A CONSUMER

14.1 This clause applies only if you are a consumer. 14.2 We are responsible for foreseeable loss or damage caused by our breach of these Terms or our negligence, but not for unforeseeable losses. 14.3 Products are supplied for domestic and private use only. We accept no liability for any commercial, business, or resale use, including loss of profit, business interruption, or loss of business opportunity. 14.4 Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, breach of the terms implied by section 12 of the Sale of Goods Act 1979, breaches of sections 13–15 of that Act, or defective products under the Consumer Protection Act 1987.

EVENTS OUTSIDE OUR CONTROL

15.1 We will not be liable for any failure or delay in performance caused by an Event Outside Our Control. 15.2 An “Event Outside Our Control” means any act or event beyond our reasonable control, including strikes, civil unrest, war, terrorism, fire, flood, epidemic, or failure of transport or telecommunications networks. 15.3 If such an event occurs we will contact you as soon as possible and our obligations will be suspended for the duration of the event. We will arrange a new delivery date once the event has ended.

COMMUNICATIONS BETWEEN US

16.1 “In writing” includes email. 16.2 If you need to contact us to cancel an order or for any other reason, please email hello@cosmacure.com or write to us at our registered office address. 16.3 We will contact you by email where appropriate.

OTHER IMPORTANT TERMS

17.1 We may transfer our rights and obligations under the Contract to another organisation without affecting your rights. 17.2 You may only transfer your rights or obligations if we agree in writing, except that you may transfer the benefit of the Contract to a gift recipient without our consent (but you must notify us). 17.3 No third party has any rights to enforce these Terms except as expressly stated for gift recipients. 17.4 If any part of these Terms is held to be unlawful or unenforceable, the rest will continue in full force. 17.5 Any failure or delay by us to enforce our rights does not mean we have waived them. 17.6 These Terms are governed by English law. For consumers, the courts of England and Wales will have non-exclusive jurisdiction (or the courts of Northern Ireland or Scotland if you live there). For business customers, the courts of England and Wales will have exclusive jurisdiction. 17.7 We do not keep a separate filed copy of the Contract.
